North American Free Trade Agreement Certificates of Origin 2018 Renewals

Any 2017 blanket period NAFTA Certificates on file will expire at the end of the year. Please forward via email any 2018 NAFTA Certificates of Origin to hwaldraff@tacustoms.com and tdoeseckle@tacustoms.com or your Trans American Personal Account Manager. To make a claim for NAFTA duty free preference, the Importer must possess a Certificate of Origin at the time the claim is made.  To certify that the goods qualify for the preferential tariff treatment under NAFTA, the exporter must complete a Certificate of Origin.   A NAFTA Certificate with claim is subject to NAFTA verification by Customs.

Requirements for Subheading 9801.00.10 – U.S. and Foreign Goods Returned Duty Free Claim

Please be reminded that if a goods returned claim is made under tariff 9801 for duty free treatment, the Importer of Record has the responsibility to provide certain documentation if requested by U.S. Customs to support the claim. No Break Seen in U.S. Transport Pricing Pressure

As required by U.S. Customs Regulations for due diligence by a Customs Broker, please make note of the following as under 19 CFR 111.29: If you are the importer of record, payment to the broker will not relieve you of liability for customs charges (duties, taxes, or other debts owed U.S. Customs (CBP)) in the event the charges are not paid by the broker. Therefore, if you pay by check, customs charges may be paid with a separate check payable to the “U.S. Customs and Border Protection” which will be delivered to CBP by the broker.

Royal Assent Provided to Bill C-23, Preclearance Operations with the U.S.

On December 13, Bill C-23: An Act respecting preclearance of person and goods in Canada and the United States received Royal Assent.  Once enabling regulations are in place, Canada and the United States can ratify the Agreement and start expanding preclearance operations to other modes of transportation – land, rail and marine – in addition to new locations in the air mode.  The agreement also opens the door to explore possibilities for cargo preclearance.  The regulations for the air mode are expected to be in place by the end of 2018.  The Government of Canada Public Safety Canada News Release is available at the following link: https://www.canada.ca/en/public-safety-canada/news/2017/12/canada_is_one_stepclosertoexpandingpreclearanceoperationswiththe.html
