House Representative Bill Pascrell recently introduced legislation that is to create administrative protective order (APO) procedures within U.S. Customs (CBP) anti-dumping and countervailing duty evasion investigations. The new legislation would require CBP to enact procedures on sharing of proprietary information under an APO that is to protect against public disclosure and provide limited access to information for the alleged evader and the petitioner. The proposed bill would also allow the Department of Commerce to issue countervailing duties based upon currency manipulation and its impact on a U.S. industry.
